1. Introduction
These Terms of Service ("Terms") govern your access to and use of the Atlas, the website (www.atlas.bot), products, and services (collectively, "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to all the terms of this agreement, you are not authorized to access or use the Services.
2. Using the Services
- Who can use the Services
You may use our Services only if you can form a binding contract with us, and only in compliance with these Terms and all applicable laws. Any use or access of the Services by anyone under the age of 13 is prohibited.
- Our license to you
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Services.
- Commercal use of the Services
Unless you have a separate agreement with us, you may not resell, rent, lease, distribute, or otherwise commercially exploit the Services or any portion thereof.
3. Security
We take reasonable steps to protect your personal information from loss, theft, misuse, unauthorized access, disclosure, alteration, and destruction. We also take reasonable steps to protect our servers and networks from unauthorized access or use. We cannot guarantee that unauthorized third parties will not gain access to your information. Please notify us immediately if you become aware of any unauthorized access to your account.
4. Termination
We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. We reserve the right to refuse service to anyone for any reason at any time.

You agree to indemnify, defend, and hold harmless Atlas and our subsidiaries, affiliates, and other third parties (collectively, "Atlas Parties") from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising out of or related to your use of the Services, your breach of these Terms, or your violation of any law or the rights of a third party.
6. Disclaimers
The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, we exclude all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL ATLAS OR ITS PARTIES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THE SERVICES, EVEN IF ATLAS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
8. Dispute resolution
For any dispute you have with us, you agree to first try to resolve it informally by contacting us at [email protected] or by joining our support server.
9. Governing law
These terms shall be governed by the laws of Australia and are subject to its exclusive jurisdiction.
10. Changes to the Terms
Notification procedures will be used to inform you of changes to the Terms. If you do not agree to the changes, you must stop using the Services. If you continue to use the Services after the change becomes effective, you agree to be bound by the changed Terms.
